By submitting this form you are signing a binding agreement that covers this visit and every future visit to TYPTI Topanga Village.
In consideration of being permitted to enter TYPTI Topanga Village, a TYPTI Racquet Centre operated by TYPTI, Inc., located at The Village at Topanga, 6256 Topanga Canyon Blvd, Suite 1240, Woodland Hills, California (the "Facility") on this and every future occasion, and to attend, observe, and/or participate in any activity offered at or by the Facility, including without limitation TYPTI play, open play, LiveBall, lessons, clinics, leagues, tournaments, exhibitions, table tennis, fitness and training, equipment demos, retail shopping, special events, and use of the courts, arenas, equipment, and premises (collectively, the "Activities"), I, the undersigned, on behalf of myself, any minor participant(s) for whom I sign, and my and their heirs, personal representatives, and assigns, agree as follows:
1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK. I understand that TYPTI and the Activities are physically demanding racquet sports involving fast-moving balls, swinging racquets and paddles, sudden movements, running, jumping, close-quarters play, incidental body contact with other players, and the use of hard-surface courts and sports equipment. I acknowledge that these Activities carry inherent risks that cannot be eliminated regardless of the care taken, including but not limited to sprains, strains, fractures, cuts, bruises, concussion, eye injury, cardiac events, heat-related illness, contact with other participants or spectators, slips and falls, property damage, and, in rare cases, permanent disability or death. I also understand that risks may arise from crowds, spectators, retail displays, equipment, maintenance or construction work, and the condition of the premises, parking areas, and surrounding common areas. I knowingly and voluntarily assume all such risks, both known and unknown, whether or not caused by the negligence of the Released Parties, and I take full responsibility for my participation.

2. RELEASE AND WAIVER OF LIABILITY. To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue TYPTI, Inc. ("TYPTI"), its parent, subsidiary, and affiliated companies, OLO, Tennis Warehouse and Warehouse Sports, the owners and management of The Village at Topanga, and each of their respective owners, officers, directors, members, employees, contractors, coaches, volunteers, sponsors, exhibiting players, and agents (collectively, the "Released Parties") from any and all claims, demands, losses, liabilities, and causes of action of any kind arising out of or related to my presence at the Facility or participation in the Activities, including those caused in whole or in part by the ordinary negligence of the Released Parties, to the fullest extent permitted by California law.

3. INDEMNIFICATION. I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorneys' fees, that they may incur due to my presence at the Facility or participation in the Activities, including claims brought by third parties arising from my conduct.
4. MEDICAL FITNESS AND AUTHORIZATION. I represent that I am in good health and have no physical or medical condition that would prevent my safe participation. I will inspect the Facility and equipment before use and will immediately stop participating and notify staff if I observe an unsafe condition. In the event of injury or illness, I authorize TYPTI staff to secure emergency medical treatment on my behalf, and I agree that I am solely responsible for all costs of such treatment. I understand that the Released Parties do not provide medical insurance for participants.
5. PHOTO, VIDEO, AND MEDIA. I understand that the Facility and its events may be photographed and recorded, including for security purposes. My permission for TYPTI to use my name, image, likeness, or voice (and that of any minor for whom I sign) in promotional or commercial materials is optional and is given only if I check the separate media consent box below. Declining has no effect on my ability to participate.
6. RULES AND CONDUCT. I agree to follow all posted rules, staff instructions, and standard safety practices, to use equipment only as intended, and to wear appropriate athletic footwear and attire. TYPTI may remove any person from the Facility for unsafe or inappropriate conduct without refund or liability.
8. DURATION AND GENERAL PROVISIONS. This agreement is continuing and applies to my first visit and to every subsequent visit to, and every Activity at, the Facility, without expiration and without the need to sign again, until I revoke it in writing delivered to TYPTI, and such revocation applies only to future visits. This agreement is governed by the laws of the State of California, and any dispute shall be brought exclusively in the state or federal courts located in Los Angeles County. If any portion of this agreement is held invalid, the remainder shall continue in full force and effect. This agreement is intended to be as broad and inclusive as permitted by California law and is binding on my heirs, executors, and assigns.
9. MINOR PARTICIPANTS. If I am signing on behalf of a minor participant, I represent that I am the parent or legal guardian of each minor named in this agreement and have full legal authority to sign for them. On the minor’s behalf and on my own behalf, I agree to every term of this agreement, including the assumption of risk, release, and covenant not to sue in Sections 1 and 2, and I release the Released Parties from all claims that I or the minor may have, including my own claims for the minor’s medical expenses, loss of services, and emotional distress, to the fullest extent permitted by California law. I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by or on behalf of the minor arising from the minor’s presence at the Facility or participation in the Activities. I understand that minors must be supervised by me or another responsible adult unless enrolled in a staff-supervised program, and I consent to emergency medical treatment for the minor as described in Section 4.
